Amending and supplementing the Electricity law of Vietnam
The investment in transmission infrastructure system to catch up with the progress of building new power plants is a challenge for Vietnam Electricity (EVN) in the context of (i) limited self-funding; (ii) absence of Government’s guarantee due to the limited of public debt; (iii) issues related to compensation for site clearance or investment projects using forest land.
To overcome the challenge, the Ministry of Industry and Trade (MOIT) has proposed to the Government and National Assembly to develop the Law on amending and adding some articles in the Electricity Law to “timely adjust the social relations arise in real operation and use of electricity”, and especially to be able to implement Politburo’s Resolution No.55-NQ/TW dated 11th February 2020 on Vietnam’s national energy development strategy to 2030, with a vision to 2045 (Resolution No. 55-NQ/TW). Economic, Financial, and Legal experts from the Vietnam Initiative for Energy Transition (VIETSE) collaborated with the researchers of the Legislative Research Institute (under The Standing Committee of the National Assembly) to examine the relevant documents on Law on amending and adding some articles in the Electricity Law as well as written guideline instructions.
